General Terms and Conditions MXGP of Switzerland

  1. General Conditions

MXGP Suisse AG (organizer) organizes the MXGP of Switzerland (MXGP) together with Infront Moto Racing. They are the owners of all rights that exist in connection with it. By purchasing an admission ticket to the MXGP, the purchaser accepts these general terms and conditions. The holder of an admission ticket who has not purchased his admission ticket through the ticket providers designat-ed by the organizer, or who has otherwise become the holder of an admission ticket, accepts these General Terms and Conditions at the moment he takes possession of the admission ticket. The MXGP will take place outdoors in all weather conditions.

The instructions of the organizer’s staff must be strictly followed. Failure to do so will result in expulsion from the MXGP area without refund of the ticket purchase price. The organizer reserves the right to take civil and criminal action.

The MXGP-area consists of the following closed off areas: Public-Area (Track), Paddock and Campsite. Access to the MXGP-area resp. to single sub-areas is only possible with a valid entrance ticket at the access times published for the respective cate-gory on the website of the organizer.

The visitor agrees to be recorded as part of the audience before, during and after the MXGP on picture, sound and video recordings. These recordings may be used and exploited commercially and without compensation by the organizer and/or third parties. He expressly and irrevocably waives the assertion of his personal rights in this regard.

Children up to the age of ten may only enter the MXGP area if accompanied by an adult. The accompanying person is responsible for the observance of the safety measures (e.g. securing of the track). The organizer declines any responsibility and/or liability in case of non-compliance.

  1. Noise emissions

During motorsport events, there may be a risk of possible hearing and health damage due to the loudness. Hearing protection plugs will be handed out at the entrances to and at special locations on the MXGP area.

The organizer declines any responsibility for possible damage to hearing or health.

  1. Security

The organizer’s security service will carry out security and entry checks at all official entrances as well as on the MXGP area and paddock during the entire duration of the MXGP. The right to deny entry or to expel the visitor from the MXGP area for good cause is reserved. If the visitor is not at fault, the organizer may, at its discretion, refund the purchase price of the ticket.

Failure to comply with these General Terms and Conditions constitutes an important reason.

  1. 4. Access to and behavior on the MXGP area
  • Traffic

Parking on the access roads to the MXGP area is strictly prohibited. Vehicles parked on the access roads or not in the assigned parking spaces will be towed away without prior notice and at the owner’s expense. The vehicle owner will be charged and must pay all expenses once the towing service is ordered. Parking of vehicles is at the owner’s own risk. If possible, public transport is to be used.

  • Entry

The admission ticket must be exchanged for a control wristband at the official box offices and exchange stations of the organizer. The control bracelet is personal and non-transferable. Each person entering the MXGP area must wear the control bracelet tightly closed around the wrist before entering. Damaged wristbands and wristbands that are not firmly fastened around the wrist do not entitle the wearer to use the services of the organizer, in particular not to enter, and are invalid. Depending on the wristband, the control bracelet entitles the wearer to enter the MXGP area or the paddock during the time period stated on the admission ticket. Lost admission tickets, free tickets or control bracelets will not be replaced in principle. Persons who are on the MXGP area without a properly fastened wristband will be expelled and reported. The organizer reserves the right to change the admission times without prior notice. The organizer assumes no liabil-ity for delays at the entrance.

  • Recordings

Recordings for private use are generally permitted. The commercial use and exploitation of images, sound, film and video recordings of the MXGP starting pilots, visi-tors or the infrastructure is prohibited. Violations will be prosecuted under civil and criminal law.

  • Further rules

Prohibited objects on the MXGP area are:

  • All firearms, spray weapons, stabbing weapons, percussive weapons and other objects classified as dangerous, in particular pocket knives.
  • drones and other airworthy devices, with or without cameras
  • rollerblades, skateboards and kickboards, roller skates, bicycles, etc.
  • Glass
  • -Pyrotechnic objects, petards, dry ice
  • power saws

There is a simple depot system for any type of glass bottles. For each glass bottle a deposit of CHF 2.00 is due at the time of purchase. The CHF 2.00 will be refunded when the glass bottle is returned.

Sleeping overnight on the MXGP area (track) is generally prohibited.

No fires may be lit on the MXGP area without permission of the organizer.

  1. Tickets

Tickets can only be purchased through the ticket providers designated by the organizer.

  • Claim for return or refund

There is no right of refund on the purchase price of the ticket, unless the event is cancelled up to 48 hours before the start. In this case the validity of the tickets will be transferred to the next MXGP of Switzerland event. In particular, visitors acknowledge that the race program may be subject to changes at any time, even at short notice; be it that start times are postponed, be it that a race run is cancelled. These and similar circumstances do not justify either a right to return the admission ticket or a claim for refund of the purchase price of the admission ticket.

  • Resale of Tickets

The purchase of tickets for the purpose of resale is prohibited. The organizer will carry out appropriate checks and may block tickets purchased for the purpose of resale and declare them invalid. The organizer reserves the right to take civil and criminal action.

  1. Liability

The organizer is liable for personal injuries in connection with the race. To the extent permitted by law, any liability of the organizer for its own conduct and for the conduct of its auxiliary persons is excluded. In particular, the organizer and its auxiliary persons shall not be liable for bodily injury or prop-erty damage caused to visitors by third parties (e.g. stand operators). The organizer is not responsible for lost or stolen items. Lost property will be handed over to the lost and found office Frauenfeld after the MXGP.

  1. Final clauses

If MXGP has to be cancelled or postponed due to force majeure (e.g. war, bad weather, catastrophes, riots, terrorist threat, warning or act, epidemics, pandemics, official ban or non-approval of MXGP through no fault of the organizer, etc.), there is neither a claim for return of the ticket nor for refund of the purchase price of the ticket, but the ticket can only be exchanged for a ticket for the next edition of MXGP. In exceptional cases, the organizer can decide at its own discretion and on a case-by-case basis whether the purchase price of the ticket, less a handling fee of 10% of the purchase price (maximum handling fee CHF 50.00), will be refunded instead. There is no entitlement to this.

If the MXGP has to be interrupted or canceled due to force majeure, there is neither a claim for return of the admission ticket, nor for refund of the purchase price of the admission ticket, nor for exchange for the next edition of the MXGP. An interruption of the MXGP is considered to be any temporary interruption (e.g. due to bad weather) that has taken place since the opening of the MXGP. An interruption is considered to be any interruption that has taken place since the opening (e.g. due to an official ban).

Changes to these General Terms and Conditions must be made in writing.

There are no ancillary agreements.

The organizer reserves the right to change these General Terms and Conditions at any time. Amendments shall be deemed to have been accepted unless objected to within 30 days of publication. These General Terms and Conditions shall be governed exclusively by Swiss law, to the exclusion of its conflict-of-law rules and the Vienna Sales Convention. The place of jurisdiction for all disputes shall be exclusively Frauenfeld, Switzerland.
